1 - Purpose of Contract
This contract is between the EARL Marcel Lecoufle and the client, regulated by the standard rules of an online transaction.

2 -The EARL Marcel Lecoufle advertise the essential characteristics of all goods and services available listed in their online catalog. ( Name, reference, etc…)
Orders are processed upon receipt of settlement (credit card or check).
Payment is to be made by credit card via the secure online system by check issued by a bank whose registered address is within Metropolitan France.

These products and services are offered within the limits of available stocks.
The products are delivered by the French national post.

3 - Notification of order
The order is placed on our site www.orchidee lecoufle.fr-by selecting a product and placing it in our online shopping cart. When the customer acknowledges having read and accepted the general conditions of sale and select the payment method, the order is then processed.
The client is requested to acknowledge his notification of order certifying that the company has taken the order into account.
The client’s responsibility for his order is established as soon as he is advised that his order has been processed.
This acknowledgment treats the essential components of an order such as:
- Order Number
- Date
- Name and address of the client, billing and delivery address.
The e-mail
- The item numbers and quantities of products ordered
- The total amount of the order, inc. VAT.
4 - Shipping and cost
Prices are in euros, inclusive of all taxes but excluding postage and packaging costs.
The VAT rates applied are 5.5% or 19.6% depending on the nature of the product.
Prices shown on our website may be modified at any time.
The packing and shipping cost for Metropolitan France and Monaco is 15 € per package.
The packing and shipping costs for Metropolitan France and Monaco are free of charge when the order amounts to 120 € and above.
The cost for the European Union and abroad is 25 € per package but shipping is free for deliveries made within the European union and the French Overseas territories when the order amounts to 150 € and above.
5 - Geographical restrictions
The online sale of products and services presented in this site is solely for European Union and French Overseas territories residents.
6 – Delivery
After confirmation of the order processed online, or after receiving and cashing the check relevant to the payment, the product is delivered to the shipping address indicated on the order confirmation providing that the geographical area is among the ones listed above.
7 –Delivery (bis)
Deliveries will be made via"La Poste" (French postal administration) by form of transport called "Colissimo suivi" for deliveries made in France and in other countries accepting this form of transportation.
Deliveries are made to Metropolitan France, the French Overseas Territories, Monaco and the European union with the exception of the ile de la reunion.
8 – Delivery schedule

The time period listed in the Shipping chapter are for information only and do not refer to strict deadlines.
If a product ordered becomes unavailable, the customer will be informed of the inconvenience immediately and will be given the option of a full refund or a change of product.
The EARL Marcel Lecoufle cannot be held liable on failing to delivery a product within the usual delay in case tragic events sustained beyond its control. (fire, flood, storm, strikes, riots, Deep freeze, heat wave ...) Delivery is to be made to the address and to the person specified in the order.
The invoice is sent to the address of the purchaser.
The Product ordered by the client is his responsibility from the moment the package leaves from our premises.
Upon delivery of the package, the client will check the general appearance of the product. Any claim must be addressed and reported to the EARL Marcel Lecoufle within 3 working days from delivery.
9 – Guarantees
the present contract is subject to the French and the European rights :
(legal guarantee of conformity of goods)(Article L-211 of the Consumer Code) and the legal guarantee against hidden defects (Art.L-1641 of the Civil Code).
In the event of a complaint or an objection, our staff will always receive the customer thoughtful consideration, teh buyer’s honesty always being presumed when the situation is clearly explained, provided that the client has kept all necessary purchase receipts.
In the case of a dispute, we strongly advise the customer to first get in touch with us within 3 days of the delivery time.
In the event of an obvious wrongdoing by any representative of our company, the EARL Marcel Lecoufle will replace the defective product at its expense if the complaint is reported within 3 days from the date of delivery.
We can not guarantee the flowering plants in the period notified on each product description. Our orchids are all grown through the in-Vitro method.

10 – Payment
Payment is made by credit card (Carte Bleue, Visa, Eurocard / Mastercard-entry via the secure website of the bank by SSL), or by check. However, please note that we will only accept French cheques issued by French banks. ( Account holders residing in France.) All cjeques in euros are to be sent to :

11 – Goods ownership
Our company remain the owner of the goods until they have been fully paid by the customer. The EARL Lecoufle Marcel reserves the right to cancel any order from customers having engaged a litigation that can not be resolved due to lack of communication from them.

All materials and pictures on this site are the sole property of EARL Orchdées Marcel Lecoufle.
Reproduction or use of all or part of the material in any form is prohibited other than for personal non commercial use. No license is granted to reproduce or use the material for purposes other than regular web-browsing.
The products shown and methods described on this website are subject to intellectual property rights, including patents and patent applications, used under license by Inov’art.
Data information collected for the purpose of online trading is required, this information being essential for processing, routing orders and issuing invoices.
Lack of information will lead to the order cancellation.
According to the law "Informatique et Libertés", the data containing a private customer’s personal information has to be transferred to the Commission Nationale de l'Informatique et des Libertés (CNIL). Toutes ces données peuvent être modifiées par le client. Celui-ci est en droit de demander sa suppression du fichier client de la EARL Marcel Lecoufle.

15 - Disputes and Applicable Law
These general conditions of online sales are subject to French law.
EARL Marcel Lecoufle in regards to the objects of contention: the present contract is subject to the French and the European rights. The company cannot be held for responsible in any case of damages, such as material, immaterial or corporal, that could result from bad functioning or wrong use of commercial products.
Should difficulties appear when applying to the present contract, the customer has, before any official course of action is processed, the possibility to look for an amicable settlement with either the help of a sale professional association or a customers association or any other advice of his choice.
Looking for the amicable solution does not interrupt the "short waiting period" of the legal guarantee nor the guarantee period. It is important to note that, generally and subject to the court of law appreciation, the respect of the clauses relating to the contractual guarantee described in this contract , implies that the buyer honours his financial commitments towards the seller.
